What Law Requires Us To Pay Taxes?

1040 Tax FormsHardly a week goes by when someone doesn’t discover my page on IRS tax brackets and leaves a comment about how there is no law requiring us to pay income taxes. Every once and a while, you hear a story about someone refusing to pay their taxes and getting locked up and penalized for it. Case in point, just last month a couple in New York were convicted, between them, of seven felony counts (5 counts of tax evasion and 2 counts of conspiring to defraud the government).

You are legally required to pay income tax. To argue otherwise is at best a political statement (which I think is fine, it’s our First Amendment right) and at worst a one way trip to the slammer.

Internal Revenue Code

Tax law itself is codified in the Internal Revenue Code, which is known as Title 26 in the United States Code. The United States Code, as defined by the Government Printing Office, is the codification of general and permanent laws of the United States. It’s divided into fifty “titles” (or volumes) and published by the Office of the Law Revision Counsel of the U.S. House of Representatives every six years, with supplements being made available between editions. In layman’s terms, the United States Code is the collection of laws passed by the legislature and signed by the executive – the Code is law.

Title 26 covers the Internal Revenue Code. The Code itself is a collection of laws that were passed by Congress and bits and amendments were passed through the years. When people talk about AMT reform, they’re talking about passing amendments to adjust who gets affected by the Alternative Minimum Tax.

Which part of the Internal Revenue Code requires us the pay taxes? Section 1 (26 U.S.C. § 1), it states:

There is hereby imposed on the taxable income of every individual … who is not a married individual a tax determined in accordance with the following table ….

There you have it, right in the first section of the Code. When taxes are due is set in Section 6076: “[R]eturns made on the basis of the calendar year shall be filed on or before the 15th day of April following the close of the calendar year.” If you are unconvinced, I think I’ve discovered the single most valuable resource on the Internet with regards to the mandatory nature of income tax at Jon Siegel’s Income Tax Page. If you’re really interested, you could spend a good hour poking around at everything in there. Professor Siegel is a Professor of Law at The George Washington University Law School, he knows his stuff.

Finally, if you have any other frivolous tax arguments, the IRS has refuted practically all of them by now, including the one about how payment of tax is voluntary. Maybe you can find a new one and get yours added to the list!

  1. Interesting! I have had several people tell me that we shouldn’t have to pay, and it’s one big conspiracy!

    Not sure that’s the case.

      …I agree that we shouldnt have to pay, and I dont agree that just because a corporation has its own code, that that makes it law for me personally. I know they have means and power far greater than little ol me, however, what if they didnt know that I made any money last year? How would they collect then? The Federal Reserve (a privately owned bank) says that because Im a member of the US, I owe them money, and with the help of the Gov. has set up the IRS to help collect… The answer that the IRS code required us to pay, to the question: “What LAW requires us to pay taxes?” at least our federal taxes, doesnt do it for me. Thats like me walking up to someone on my street and telling them they owe me money cause my code says I so, and that means its law to you. Furthermore, IF the statement: “There is hereby imposed on the taxable income of every individual…” is out of the IRS code information, it simply states that the taxes are imposed on “TAXABLE” income. So refering back to my question; What if they are unaware of your income? How are they going to tax it? Its like babysitting… The babysitter does a job and gets paid. Is it taxed? No. Cause its not “taxable”? Perhaps. But taxable or not, the IRS doesnt know about it, therefore cant tax it anyway. And no “LAWS” or codes are being broken… Think about it… All you have to do is discontinue the IRS from its awareness of your income somehow…

        If you lie in informing the IRS on how much income you made, it is considered tax evasion and attempt to defraud government. Lets be reasonable. Taxes have been a part of society since the beginning of civilization, deal with it.

  3. Both sides are right…to a certain extent. We do have to pay taxes. However, the law requiring us to pay taxes is not constitutional.

      The 16th Amendment to the US Constitution:

      “The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.”

      I don’t see how anyone could argue its unconstitutional since its explicitly in there.

        That Amendment wasn’t even ratified properly. does not give Congress the right to tax people’s incomes.

        All taxes levied by Congress have to be uniform and based on the Census, as proscribed in Section 9, Clause 4 and Section 2, Clause 3. The income tax is neither.

        Of course, it really doesn’t matter. The government has enough guns to force you to pay the income tax, thus you have to pay it.

          Claims that the 16th amendment isn’t valid are frivolous and bogus attempts by tax evaders. US courts have already dismissed the argument that the 16th amendment wasn’t ratified properly.

            Well in the 80′s the suprime court in California actueally found it UN-constitutional and ruled we are not required to pat an income tax.

            I Have yet to pay income taxes. the IRS comes at me each year, i explain to them i am not legally required to pay the agent says i am sorry for bothering you and they leave me alone for a another year or 2. They haven’t bothered me for 3 years actually maybe they made a note of it. lol none the less i am not in jail and my wages have not been messed with.

        Yeah but if you look the 16th amendment was never ratified by the states there for its not law . Check that out and let me know what u think bout that ? If it was never ratified that means it was never law . There are several cases in the supreme court where they declared taxes on labor unconstitutional.

        1. That ammendment wasn’t ratified by a suffcient number of states. So it should actually be seen as invalid. However it was basically just “thrown in there” by the government amnd now we are just supposed to “deal with it”

        2. Originally the constitution was supposed to protect us from taxation without representation which coincidentally was one of the key reasons the revolutionary war was fought for. However this ammendment (that wasn’t ratified) does the opposite and imposes taxation without representation which is exactly what the quote you posted says.

        The term: Tax-Payer had to have come from somewhere… Yes?
        Maybe it evolved from the existence of an obvious other term, namely:
        Non Tax-Payer (Or, vice-versa)
        Come on folks…. The latter term does exist!

        If a Tax-Payer classification is determined by a law, there’s logically a Non-Tax-Payer classification, otherwise, Why make any distinction? All bears do something in the woods but some Dance”, hence, “Dancing Bears” as apposed to plain ole’ bears.

        Thinking’s not as risky as a willful failure of something required so scarf it up.

        I amuse myself with such foolish ideas of how easy it would be if someone else would pay my obligations. You know… legally as a “Proxy”… Like in the Bible story where “One” generously paid-off everyone’s bill. You know, a lot of folks “Think” that happened so they really do believe it. So many so…. that Judges are required to uphold the same foolish concept and as evidence of that, they require us to swear our truth against a Bible…. Which, of course, some choose not to believe in. But, what the hey… we’re capable of our own individual thoughts. Even if those thoughts are spoon fed from birth by Tax-Payers… We do believe in taxes, I “Think”

            He seems like a slave to this fucked up economic monopoly that has seemingly taken place in this nation and the world. How the federal reserve bank works is every dollar that is printed off has debt associated with it and no matter how much money we print off it is still going to leave us in debt. Income tax, about 25% of all of our earnings goes to pay off this debt off. Not to the roads, schools, or anything else. The federal reserve is not an institution of the united states its a seperate banking enterprise that consist of some of the most corrupt individuals in history. For an example of how corrupt they are, they knowingly caused1 the stock market crash by starting a loan for stocks where you only have to pay 10% of the value of the stock, well the only stipulation is that they can request the other 90% of the money you owe anytime they want. They called all the loans in at the same time and that caused everybody to sell their stocks causing a nation wide panic and depression and they used that time where corporations were almost in bankruptcy to buy up corporations and previously healthy smaller banks didn’t print any other money off which caused the country to stop the idea of the money being backed by gold. Our money used to say this is one dollar of cold, now our money says legal tender which basically means its worthless crap. The great depression was the biggest robbery in our nations history and that’s only one of the many fucked up things the fed does to us.

            As far as the bill to pay income tax, It wasn’t ratified by enough states to make the bill on income tax legal and the fact that we have to pay 25% of our income to this corporate monopoly is modern day slavery and we should be rioting in the streets because of this fraud that has taken place for almost a century now.

          Bardillo, Yours is the most ridiculous argument I have ever heard. I am interested to know more about state tax laws. I recently sold a car and since it was after May, I will be required to keep it assessed and pay taxes for the entire year. How can we be taxed for something we no longer own?

      There WAS a law that said that Blacks needed to attend different schools than Whites.

      However that is UNCONSTITIUIONAL therefore NULL AND VOID, just as the Income Tax should be.

        The jim crow laws were declared Unconstitutional by the Supreme Court, and struck down. The Supreme Court has not done so with income taxes.

        The exact opposite has happened when it has come to most tax laws. The courts have upheld income taxes again again.

        If you want to argue that the Court cannot decide what is and what isn’t constitutional then anybody could do as they please as we would all individually be arbiters of the law.

          Amendment 10: “powers not delegated to the United States…are reserved to the States, or to the people.”

          Amendment 11: “The Judicial Power of the United States shall not be construed to extend to any suit in Law or Equity.”

          “Law” refers to English Common Law, or jury trials. The idea is that anybod has the right to do whatever they want, so long as the jury of peers (others in society) finds them not guilty.

          The Supreme Court has no constitutional power to interpret the constitution in any way. That power is reserved to the people.

          If you give all the power to interpret, change and enforce to the government, you get a fascist state.

    The “Internal Revenue Code” is not a law; they are guidelines created by the executive branch on how the IRS should tax the public, and how the public should be obedient and pay the taxes.

    That being said, the “code” was never created by the legislative branch (called a Bill) and was never voted on to become a law. Why not?

    Because of what Jim mentioned regarding the 16th amendment to the Constitution. Great and dandy; it’s an amendment, and amendments are laws.

    Hold on there smokey, not in this particular case. Amendments must be legally ratified, and the 16th was never properly ratified as Krod mentioned. This makes the “amendment” technically not a law.

    The problem is that the IRS has been given WAY too much power in its execution of their “code”. Don’t pay your taxes because its not a law, seems logical right? Wrong. This is not a democracy, law doesn’t matter. The police state swoops down on you, takes your house, charges you with tax evasion, and makes a case based off the fact that you didn’t pay taxes because you didn’t abide by the “code.”

    However, most people by this point (especially after the IRS seizes everything before a trial), are not in a state where they could defend their action; would you want to fight the IRS when they seize your crap? No, you wouldn’t.

    How are they able to seize your crap before you go trial? Easy: the “code” says you can, duh. I’m scared of the IRS, thats why I pay my taxes; not because it’s a law. I accept the fact that we don’t live in a republic free-enterprise state (bail-out what?).

    Wake up people, we live in an emerging neo-police socialized state. Both parties like bailouts, yum. Yum yum bailouts. More money for both parties to stick into their corporations. Yum yum. Who are the republicans? Who are the democrats? Cartels. Both cartels vying for money and power in the new policed socialized state.

      Mike, I think you are confusing “Regulations” with the “Internal Revenue Code”. Regulations are the rules that the IRS has created to implement the IRC pursuant to rulemaking authority granted to it by Congress in the IRC. The “Internal Revenue Code” is the law passed by Congress. Check out Professor Siegel’s website for more details.

        Stop responding to the all-caps “name” they slapped on a birth certificate tracked with a Social Security Number and said it was you. “Legalese” operates solely on “names.” company names, “person” names…

        Think about it, what law requires you to have name? NONE. And if you refuse to represent that name that the charges are against, they have only one option:

        Trial by jury, with is what the Fathers wanted when they created the constitution.

        How could a jury convict you? THERE ARE NO WITNESSES THAT SAW YOU (IN THE FLESH AND BLOOD) WILLFULLY FAIL TO FILE! YOU CAN’T SEE SOMEBODY NOT DO SOMETHING!

        “If there is no victim, there is no crime.”

        Who is the victim? Nobody. If they say “The IRS” is the victim, tell them a company cannot be injured because it’s not real. Only real people can claim injuries.

        Also, where is the contract? Unless it is clearly stated in these “adhesion contracts” there is no full-disclosure and it’s null and void.

      …There is one thing however, and I commented on it above. In what ways is the IRS informed of what they say we owe? Cause we tell them, right? What if all we had to do was keep our mouths shut, and they would have no information telling them to collect anything. Your name wouldnt even come up… No taxes, no jail, no seizures of property, no laws or codes being violated…

      I was proud to be an american, and then I learned what that really meant. This federal income tax is one of so many ways that the good honest hardworking people of this once great nation are being raped and used. And everyone else, that isnt part of congress, the government, or one of these other power groups running our lives.

    What makes me mad is that so many government officials don’t seem to pay taxes and get away with it. Even if they are found to not pay taxes, nothing really happens with them. If you are I were to not pay taxes, we would have stiff penalties and sent to jail. Just seems pretty mixed up.

      It’s probably because they KNOW they do not have to pay taxes. I was watching this program that provided reasonable evidence that showed that we, the American people, are not obligated. They even had former IRS employees claim that from 1990, they haven’t been paying taxes and that was a decade ago. Now, if they are in jail, that’s unknown. Like what a few other comments said, it is unconstitutional. And like the previous comment made by vinny riddle, where he said he just tells IRS that he is does not have to legally pay taxes and they leave him alone; that is probably true.

    I have no problem with paying an income tax… though I can’t help but think there’s a better way to fund government expenditures. However, we pay (IMHO) far too much in income taxes. If government could get it’s spending in line with reality…. then we could lower taxes across the board… and folks like you and I could keep more of our earned income.

    Living in the US of A, that’s not likely to ever happen. Oh, and legality aside, Krod has a point – the US has more than enough guns to enforce payment of taxes.

      Your income tax doesn’t fund a single government program. Not one single cent goes to where you think it does.

      Income tax is used to pay back the interest the on the money teh Federal Reserve has loaned to the Government so we can have money and debt plus more debt.

      In other words every single cent we pay in income tax winds up in the pockets of some greedy filthy low life scum sucking international banker.

Our BROKE gov, post International Coporate Takeover, or as we know it, WWI, borrowed money from the Federal Reserve, but in order to do this, the Federal Reserve like any other bank, required colladeral. We are that colladeral. Your birth certificate is the “Stock” held for the corporation of the US! Check your birth certificate! It will not be the original document with the issue date the same as the birth date! Thats also why it will say “Informant” by your mothers signature. The IRS was set up to make sure the Gov. pays back whats owed. Which will never happen, and it was all planned that way from the beginning. But did you ever notice the red numbers on the back side of your social security card? What do those numbers represent? Why is your name always in all caps when dealing with any form of business or govornment issues? …Find the answers to those questions and you will be on your way to being a much more free american…

  8. I’ve hear many times the 16th amendment wasn’t ratified correctly, this led to the rise of big government. I also hear the county sheriff has the right to throw the IRS out of the county, of course 99.9% of county sheriffs don’t know this.

    First, The federal income tax is unconstitutional because it is not apportioned as the Constitution clearly states all taxes must be. Second, the 16th Amendment was never ratified according to the procedures as set forth in the Constitution. Third, the income tax (when you read the law) only applies to businesses and corporations. There is nothing in the law that requires an individual to pay a personal income tax.

    The distinction is in legal wording. Income is a legal word that applies to business profits. Earnings is a legal word that applies to wages, etc. based on an individuals labor.

    Even the IRS’s own documents substantiate this fact. The IRS clearly states that the income tax, as it applies to an individual, is a voluntary tax. Furthermore, under IRS regulations, it states that the IRS has the authority to seize business property and assets. It has no power to seize personal property or assets.

    But if other people want to keep paying taxes that they have no legal need to pay then they can keep paying. The IRS won’t stop them.

    Further more, the amount of revenue that the IRS generates each year, based on the taxation of personal income, fails to pay for anything in the Federal government budget aside from interest on the national debt. Any monkey can see that this has been the case since the income tax and the federal reserve came into existence with each budget year.

    It’s funny how a lot of you run to defend your slave masters! First of all, all of your income tax goes into the pockets of private bankers known as the Federal Reserve. Not one cent goes to pay for any government function! Everything is taxed from gasoline to your property taxes, that money goes to pay for services NOT the income tax!

    Furthermore the supreme court has ruled that the 16th amendment gave the IRS “No new taxing powers”. So if they didn’t have it before, they didn’t have it afterwords!

    And the supreme court has also defined income as “profits or gains” from corporate activity.

    To put it simply. If you run a business where you pay employees to do the work, you owe taxes on the profit of the business. That’s perfectly legal. But you, the average American working 9-5 does not have “income” as defined by the supreme court and the tax code.

    No one is arguing that the tax code is written incorrectly. It’s just very misunderstood.

    Why does the government continue to put people in jail over a debt owed to a private banking system?? This is tyranny! Why not sit down with the “tax protesters” and very clearly say “this is where you are required to pay”.

    Take Ed and Elaine Brown for example. An elderly couple who wanted nothing more than to see the law they were allegedly breaking. Instead the government spent millions of dollars to take them down and did so with violence and force rather than simply saying “here is the law. Now please pay the banking cartels their money”.

    We are living in tyranny! Do I pay my income tax? Hell yes. Is there a law to do so? No! But they have the guns.

    But tell me, is this America? This is what our forefathers died for? Anyone who doesn’t see the tyranny and defends the slave masters doesn’t deserve to breathe the air of this country!

    1) The term “income tax” can be used by the US government and its courts to
    describe revenue laws generally, or it can be used to describe a specific type
    of tax.
    2) 16th Amendment “income” and the ordinary “compensation for labor” of the
    average American are not the same thing.
    3) Each subtitle (A through E) of the IRC imposes a completely different type of
    tax and subtitle C taxes are not the same tax as subtitle A taxes.
    4) No tax law can apply to you if in doing so it would violate one or more of your
    “unalienable rights” (unless it is a direct tax).
    5) One of your unalienable rights is to exchange your labor for other forms of
    property (including money) without having to give a percentage to the
    government. The only way the government can tax such compensation is
    with a direct tax, and Congress has not imposed a direct tax upon
    compensation for labor.
    6) You need not provide an identifying number if you’ve determined the
    transaction is not taxable.
    7) No reporting is required if you’ve determined that the transaction is not
    taxable to you.
    8) If the person making a payment to you wants to report the payment even
    after you’ve made the determination that it not a taxable transaction, that
    person may do so without a number and must affix the appropriate affidavit

    9) Under the regulations created by the Secretary of the Treasury for tax
    matters, a person making a payment to you has no other remedy than the

    If it was not a law to pay taxes, then obviously by now, with the many, many people that have fought having to pay taxes…someone, somewhere would have won a court case and not had to pay taxes therefore opening it up to everyone not having to pay taxes…

      Michigan motorsports attorney Alan Miller, 71, was acquitted on all three counts of tax evasion and one count of conspiracy. The jury deliberated six days after a six-week trial.

      While the prosecution said it would review its options on the conspiracy charge, Castroneves’ lawyers said it would be “illogical to proceed” with refiling.

      Castroneves, meanwhile, talked only about racing. “Instead of going to Disneyland, I want to go to Long Beach to race,” he said, saying he was headed to California to race in this weekend’s event for Team Penske.

      He was charged with working with his sister and lawyer to evade more than $2.3 million in U.S. income taxes.

    Any lawyer would know that terms used in legal documents often have specific definitions for the purpose of said documents. If we look at title 26 what are the definitions of:

    1. Individuals
    2. Income
    3. Employees
    4. Employers
    5. Wages

    If you look, you will find the law does say we have to pay taxes. The question isn’t if we do or not. The question is which ones of us are taxpayers and which ones of us are NOT taxpayers.

    “The revenue laws are a code or system in regulation of tax assessment and collection. They relate to taxpayers, and not to nontaxpayers. The latter are without their scope.     The IRS failed to actually define the word “Income” anywhere in their IR Code manual.

    Therefore it falls to the definition that is given by the US Constitution in article 1.
    Income is described there as profit from corporate gain. This excludes wages from labor and services. Also the US Supreme court found that it is an excise tax and therefore also doesn’t apply to work wages.

    You might look at the case of Atty Tom Cryer who did beat the IRS along with several others.

    It’s also interesting that in the IR code manual, that it specifically states that people assess their tax liability and pay on a voluntary basis. This is also stated in Federal tax regulation 601.602

    And as one comment noted, the 16th Amendment was never legally ratified as at least 13 states broke the laws in their own state constitutions by voting on it before their next legislative meeting was held as required by state laws. Sec. of State Knox needed 36 state votes-he never legally got them.

    In fact it appears that the Sec of State in 1911, might have been bribed by those in the federal banking system to try and pass the 16th amendment as a way to collect the ‘interest’ from the national debt so as to gain control of the nation’s wealth.
    These guys make Madoff look like a boyscout in comparison with the ripoff they’ve done to this country.

    Plus the Supreme court also ruled that the 16th didn’t give anymore power to Congress than it already had because they have the power to lay taxes on the land as per the GUIDELINES of the Constitution. The Constitution was specific that all taxes had to be apportioned to the populous. To go against this would be have to be based on corruption and greed.

    Most of the federal taxes goes into their pockets. Some goes to the DOD and some goes to appropriate programs.

    If you file a return you then enter into a type of legal contract with the government.
    At that point you are liable.
    If you don’t then by legal rights under the US Constitution it’s strictly voluntary!

    “Invisible Contracts” What most people don’t understand is that the Supreme Court ruled in 1896 in a case called Davis vs. Elmira Savings, 161 U.S. 275 that banks are instrumentalities of the Congress. Your bank account contract is the exclusive Equity instrument that initiates the attachment of liability for the positive administrative mandates of Title 26. In other words, the interstate system of banks is the private property of the King. This means that any profit or gain anyone experienced by a bank/thrift and loan/employee credit union — any regulated financial institution carries with it — as an operation of law — the identical same full force and effect as if the King himself created the gain. So as an operation of law, anyone who has a depository relationship, or a credit relationship, with a bank, such as checking, savings, CD’s, charge cards, car loans, real estate mortgages, etc., are experiencing profit and gain created by the King — so says the Supreme Court. In the words of Supreme Court Justice Felix Frankfurter: “Equity is brutal, but we are merely enforcing agreements.” Or in other words, Judges don’t like the idea of being thought upon as being mean gestapo agents — doing the dirty work for the King. They consider themselves as being struck between a rock and a hard spot — being asked to enforce agreements and without being given any valid reason as to why you should be let out of it — other than you just don’t feel like being incarcerated. So what happens during these (Willful Failure to File) trials is that: 1. The Intelligence Division of the IRS surveys the local banks in the vicinity of the tax protester, and obtains copies of the protester’s signature card and financial transactions statements from the bank. 2. At the time the U.S. Attorney requests the Judge to sign the Summons, the Judge has been presented with your bank account information. So now during the prosecution the Federal Judge is sitting up there on the bench with your agreement with the King in front of him while the tax protester argues: “Well, Judge, the Fourth Amendment says…” “Judge, the Fifth Amendment says I don’t gotta…” Are you beginning to see why the Judge is prone to experience frustration and blurt out “the Constitution does not apply here!”? Meanwhile, the Judge is ignoring all Constitutionally related arguments and denying all motions. If you would go back to your bank and ask the manager to show you your signature card again, in small print you will see the words: “The undersigned hereby agrees to abide by all of the Rules of this Bank.” Have you ever asked to see a copy of the bank rules? If you have, you will read and find out that you agreed to abide by all of the administrative rulings of the Secretary of the Treasury, among many other things. What is really happening in these Willful Failure to File prosecutions is that the Judge is operating on the penal clause to a civil contract. And since you have agreed to be bound by Title 26, what difference does it make whether or not Title 26 was ever enacted by the Congress? A contract does not have to be enacted by Congress — in whole or in part — in order to make it enforceable. As for the actual taxation itself, what happens is that the King creates a “juristic personality” at the time you open your bank account. And it is that juristic personality (its income and assets) that the King’s Agents are “excising” back to the King. But in any event, the taxing power of the Congress attaches by contract or use of the King’s property. The Congress does not have the jurisdiction to use the police powers to raise revenue. That is the proper way (the ideal Alice in Wonderland way actually) to collect taxes, and that is the procedure by which Federal Judges are enforcing the law — not by ruling over gestapo Star Chambers. (I have some reservations on the modus operandi of Federal Judges to the extent that the Supreme Court mentions over and over again that: “Justice must satisfy the appearance of justice.” [Offutt vs. U.S., 348 U.S. 11] and that when a man is thoroughly convinced that he is on the right side of an issue — that justice has not satisfied the appearance of justice unless the criminal defendant is aware that he did wrong. And on these tax protester trials, that requires a sentencing hearing lecture by the judge to the defendant on why and where the defendant did err. So I disagree with the modus operandi of Federal Judges to this extent). So, in conclusion on this issue, if the 16th Amendment were somehow repealed tomorrow morning at 9:00am — it would not change a single thing (other than the IRS would have to start giving people a correct presentation of the law to justify the taxes). The IRS and the excise tax on juristic persons would continue on as usual. As it pertains to the proposed restraining order the King’s Agents are trying to get against you and your alter ego, please get a copy of the Complaint filed by U.S. Attorney Charles Magnuson dated January 31, 1984 — and turn to page 9. Examine the last five words in paragraph “b”: “…under the Court’s equity powers.” The charge against you is legitimate to the extent that you are in written contractual equity with the King. When you trace back the genealogy of your signature on your bank card, you will find that you agreed to be bound by Title 26, and under Section 7202 you agreed not to disseminate any fraudulent tax advice. And the concept that Federal Reserve Notes are not taxable instruments of commerce — for any reason — when the person has a written agreement with the King saying that FRN’s are taxable — this concept is in fact fraudulent. The Federal Judge probably is not going to want to disclose what document it is that you executed which created the attachment of equity jurisdiction. They have been asked not to let the cat out of the bag. The IRS handles this “bank account = equity relationship” on a military style “need-to-know” only type basis. You can file a Mandamus in the Circuit Court of Appeals or petition for a Subpoena Duces Tecum returnable against the U.S. Attorney to compel discovery of what it is that you signed that created the attachment of equity jurisdiction the King’s Agents are now acting under. This type of equity jurisdiction always attaches by written consent. Get rid of your bank accounts and your argument would then be— that you are not in an equity relationship with the King anymore. Then the Constitution would apply, but it does not apply to you now since you are in an equity relationship with the King — and private agreements overrule the Bill of Rights.

    That law this web page mentions, says that we all have to pay taxable income. It does, however fail to explain what taxable income is. Looking into it further, (within the titles) taxable income is defined as income made from the dealings, if you will from sources outside the United States.
    In the end we all read the same thing, but take with it different ideas and or meanings. Its very, very easy to say, hey, its been this way forever. And, see, we have this 500 page book that explains why you have to pay taxes, so deal with it and pay it. That is not a viable reason. Nor is “its the law” an acceptable excuse either. The people are the law. If the majority raises up and says, NO, then it becomes law. The people make the laws. Or thats how its supposed to work. Obviously, and not one person here can argue this, big money runs the government and thus the laws. I mean, even the most tired, most lazy of all Americans, are slowly, seeing that this is fact. Im a patriot. We do in fact have taxation without representation. How do I know? Ask anyone, or rather any, average anyone, how they enjoy the taxes. No one wants them and all believe they are too high, yet government, all federal, state and local, continue to raise them and, add even more. There are taxes on just about every single thing in America. And in some cases, a tax, on a tax. Silly.

The reason why most pay taxes is because you are subject citizens, under the 14th amendment and therefor responsible for the national debt which is around 6trillion plus. Also if u read into further detail, certain native americans who are now citizens are NOT subject to tax provided that such treaties were formed with there tribal government. Also, if u read law dictionaries a person is defined as a corporation And also if u read Section 2 of the 14th amendment, youll find the same. The problem is that the IRS is almost acting as if it holds the supreme law, but the last time i checked, the constitution trumps everything in a since.     Let me start by saying I hate the income taxt. I feel it is unfair and should be replaced by a national flat rate or sales tax, properly ratified of course.

    However claims that the 16th Ammendment was never ratified are incorrect. 42 states ratified the ammendment the last being Delaware on 2/3/1913. 3 states rejected the ammendment and 3 states never even took it up (being only 48 states at the time).

    The interesting thing is that the majority of support for the tax was from the western states and the most resistance was from the East with 5 of the 6 from the east coast and most of the late ratifiers were along the eastern side of the country. This is opposite of what you would expect today, California being the exception (as usuall).

It seems as though there isn’t a law that requires one to pay taxes on their ‘labor’. Federal income tax is a tax on ‘profits’ & ‘gains’. One’s labor is NOT a profit or a gain because there was an even exchange. If a person wins a lottery for $1 Million because he or she bought a $1 ticket, that WOULD be a ‘profit’ or a ‘gain’. However, if that same person paints your house for $3,000 and did it all by himself without the aid of any employees, then the $3,000 is not taxable because it was a result of his ‘labor’. Thank You

    A serious question here. We’re a “democracy” are we not? Many of us here would say no that it is just a ruse to swindle the American pub lic into obediance. Let us prove or disprove that.

    Why don’t we start a petition? A petition based upon the evidence shown in this forum.

    It is one thing to talk about it what we should do, or tell everyone to stop paying taxes. It’s a completely different thing to actually take that action. If enough of us sign and pledge that we agree that this is a fraudulent law/tax/ect… then we will see if they act on the behalf of Americans like they should or if they will stay their course.

    One true thing about the internet is that Anonymous is legion. This means many things but mostly it means we are composed of many individuals from many walks of life. Six degrees of Separation means everyone on this planet knows everyone else through no more than six other people. Let’s test that theory as well…

    Make this public, get it into the eyes of everyone. And some cunning linguist please write up a god damned petition.

    If you ‘Google’ this- AMERICA: FREEDOM TO FASCISM, and watch it on the web, you’ll be able to see and hear former IRS agents saying that there isn’t a ‘law’ that requires an American to pay taxes on his or her ‘labor’. It seems as though Americans have been misled, or confused, about what’s really true in regards to Federal Income Tax. Thank You. P.S.     As far as taxation, I think there should be a flat rate with no deductions or games – 7% – and taken out of pay if you have that kind of employment.

    What bothers me more than the fact that we have to pay taxes to avoid incarceration is the invasion of privacy. Why is it another’s business what we make? Health care reform is worrisome for this reason – I do not want any health care provider to be privy to our financial information. Medical insurance requires a social security number, and it is absolutely none of their business – but their business is to send people to the poorhouse because only THEY are worthy of income. Speaking for my own household, income taxes are not a threat to our success and comfort – but the health care system is a terrifying threat, as we are not multi-millionaires.

Before you go any further, go grab an authoritative legal dictionary. After all, we need to know that the legal definition of “taxpayer”, “must”, and “file” are the words we think they are. Can you see a problem here? There is no authoritative legal dictionary (that is a Lawyer, remember?), and so these words are left open to interpretation, as the authors of IRS related propaganda exploit constantly. If the IRS wants my money, I want the IRS to actually give me something in return.
